By visiting our Site and using our Services, including through submitting information through a Site, you acknowledge and agree that ONE PARTY RENTAL may process your Personal Data as described in this Privacy Policy.

We do not collect Sensitive Personal Data, which includes Social Security Number, driver’s license, state identification card, or passport number, racial or ethnic origin, union membership, information related to a consumer’s citizenship or immigration status.

If you do not provide personal data

Where we need to collect personal data by law or pursuant to a contract with you and you do not provide the requested data, we may not be able to perform the contract we have tried to enter into or have entered into or with you. If that is the case, we will inform you at that time and we reserve the right to cancel a service you have contracted with us.

Usage Data

We may automatically collect certain information through the use of cookies or other similar tracking technologies when you access our Site and use our Services.  Usage Data does not reveal your specific identity (like your name or contact information) but may include device, internet traffic and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you access the Site and use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Site and Services, and for our internal analytics and reporting purposes.

Where the legal basis for processing your Personal Information is our legitimate interests, those interests are to use Personal Information to conduct and develop our business activities with users and with others in order to support our reputation and increase our revenues, while limiting the use of Personal Information to those purposes that strictly support the conduct and development of our business within the reasonable expectation of the individuals concerned.

Limitation or Change of Purpose

We will use your Personal Data for the purposes for which we collected it or another purpose that is compatible with the original purpose after we disclose that to you. When we disclose Personal Data for a business purpose, such as when our service providers need to process your Personal Data, we enter into a contract with the third party recipient that describes the purpose and requires them to both keep that Personal Data confidential and not use it for any purpose except performing the services under the contract.

Where We Store Your Personal Data

We are based in the United States.  The information that we collect from you (including Personal Data) may be transferred to, and stored at, a destination outside of the country in which you initially provided or we collected it. It may also be processed by our service providers who may operate outside your country, for one of our suppliers or one of our business partners. By submitting your information, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your information is treated securely and in accordance with this Policy and applicable law.

How Long Do We Retain Your Personal Data

We keep your Personal Data for as long as reasonably necessary to fulfil the purposes for which we collected it. For example, we may retain your Personal Data as long as your user account remains open.  For certain types of information, we may need to retain it for a longer period of time to meet applicable legal, regulatory, tax, accounting or reporting requirements. We may also retain your Personal Data for a longer period in the event of a complaint or if we reasonably believe that there is a prospect of litigation concerning our relationship.

In the event we reasonably believe that we may need your Personal Data to enforce or defend our legal rights, we may retain your Personal Data for a longer period of time.  

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes by other means, as well as applicable legal, regulatory, tax, accounting or other obligations.

Facebook data deletion

If you wish to delete your account and associated data obtained through the One Party Rental app, please email support@onepartyrental.com with the subject line “Facebook Data Deletion Request.” We will remove your information from our systems within 7 business days.

You can also remove app access directly from your Facebook account settings:

  1. Go to Facebook → Settings & Privacy → Settings
  2. Click “Apps and Websites”
  3. Select One Party Rental and click Remove

Keeping Your Information Safe

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security and integrity of any Personal Data we process. In addition, we limit access to your Personal Data to those who have a business need to know. They will only process your Personal Data on our instructions and are subject to confidentiality obligations. However, despite our safeguards and efforts to secure your information, no information transmission over the Internet or electronic storage technology can be guaranteed to be completely secure, so we cannot guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly access, steal, or modify your information.

You also play an important role in keeping your information safe. Use a strong password. Do not share your log in credentials with someone else.  Public Wi-Fi is notoriously insecure, so you should only access the Site and use the Services within a secure environment.

Although we will do our best to protect your personal information, Transmission of information, including Personal Data, is at your own risk.

If we suspect that there has been a security incident involving your Personal Data, we will notify you and any applicable regulator of a breach where we are legally required to do so.

Your Privacy Rights

You always have the right to opt-out of receiving our marketing or promotional communications.  Depending on your geographic location, you may have certain additional privacy rights.  

United States: If you are in the US, you may have rights under certain US state data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law.

Exercising your rights

You may exercise your privacy rights twice in a calendar year.  To do so, you may submit a verifiable request to us by either (1) calling 843-259-2202; (2) emailing info@onepartyrental.com and use “Data Privacy Rights” in the subject line; or (3) sending us a written request to PO Box 12307 Charleston, SC 29412 Attn: Data Privacy Rights.

In order for us to act upon your request, we will need to verify your identity to a reasonable degree of certainty.  We may therefore ask you to provide three points of Personal Data which you have previously provided to us that we can use to match against our records to verify your identity. We may also require you to submit a signed declaration under penalty of perjury stating you are the individual whose Personal Data is subject to the request.  We may not be able to respond to your request if you decline to provide the verifying details or if any of the details are incorrect.

In general and unless otherwise stated in the above sections describing your rights, we will respond to your request within forty-five (45) days.  If necessary, we may extend the time to respond by a further forty-five (45) days.  If for any reason we decide to decline to respond to your request, we will notify you and provide our explanation and any appeal process that may be available to you.  

Children’s Information

Our Site is not directed to or targeted towards those who are under 18 years of age. We do not intentionally allow users under the age of 18 to access our Site or use our Services, and we do not have actual knowledge that we have collected the Personal Data of anyone under the age of 16.  If we learn that a user under 16 has submitted Personal Data to us, or if we learn that the Personal Data is from one who is under 16, we will attempt to delete that Personal Data as soon as possible.

Privacy Policy Updates

We reserve the right to amend this Privacy Policy at our discretion and at any time. International Transfers of Your Personal Data

We are headquartered in the United States, a country that the European Commission has deemed to not provide an adequate level of data protection.  Further, our affiliates and our third-party service providers having access to Personal Data may be located outside of the European Economic Area (“EEA”), and not always in a country that is recognized as having an adequate level of protection for Personal Data.  Personal Data may therefore be transferred outside of the EEA.  These transfers are necessary to perform our agreement with you or implement pre-contractual measures at your request. Exercising Your Rights

No fees are generally charged

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is manifestly unfounded, repetitive or excessive. We may also refuse to comply with your request in these circumstances.

We may ask you for specific information to help us confirm your identity and ensure your right to access your personal data (or exercise any of your other rights).
